BASIC CONDITIONS OF EMPLOYMENT ACT, 1997 (ACT No. 75 OF 1997)

SECTORAL DETERMINATION 6: PRIVATE SECURITY SECTOR, SOUTH AFRICA

CORRECTION NOTICE

I, Membathisi Mphumzi Shepherd Mdladlana, Minister of Labour, hereby in terms of section 55 (3) (b) make corrections to the sectoral determination published in Government Gazette No. 22873 dated 30 November 2001.

  1. In clause 4 (4) (g) substitute the expression "clause 9 subclause (7)" with "clause 9 subclause (6)".
  2. In clause 5 (7) (a) (i) substitute the expression "clause 3 subclause (6)" with "clause 3 subclause (5)".
  3. In clause 10 after subclause 6 (b) (ii) insert subclauses (7) and (8) to read as follows:

(7) An employer may, as a condition precedent to the payment by the employer of any amount claimed in terms of this clause by an employee require the employee to produce a certificate signed by a registered medical practitioner, or any other person who is certified to diagnose and treat patients and who is registered with a professional council established by an Act of Parliament stating the nature and the duration of the employee's incapacity: in respect of any absence from work-

  1. on more than two consecutive working days; or
  2. on the working day immediately preceding or the working day immediately succeeding, in the case of(i) a security officer a free period, public holiday or Sunday; (ii) any other class of employee a Sunday or public holiday.

(8) When an employee has, during any period up to eight weeks received payment in terms of this clause on two or more occasions without producing such a certificate, an employer may during the period of eight weeks immediately succeeding the last such occasion require the employee to produce such a certificate in respect of any absence from work.

  1. In the last paragraph of the determination, the date of the publication of Sectoral Determination 3: Private Security Sector referred to should be changed from 25 February 2001 to 25 February 2000.
